HB 484 - Safe Freight Act Summary

• Establishes the Safe Freight Act requiring all trains to operate with a minimum crew of two individuals: one Federal Railroad Administration-certified locomotive operator and one train conductor.

• Imposes Class C misdemeanor penalties for violations: first offense $250-$500 fine, second offense within 3 years $500-$2,500 fine, third or subsequent offense within 3 years $2,500-$5,000 fine.

• Provides exceptions allowing single-crew operation for helper service trains, tourist/scenic/historic operations, lite locomotives within rail yards, yard operations under hostler supervision, and trains being loaded/unloaded at 10 mph or less.

• Authorizes Alabama Public Service Commission President to grant exemptions to railroad carriers with 15 or fewer covered employees operating at speeds of 15 mph or less on tracks with minimal grade, subject to annual review.

• Requires minimum two-crew operation regardless of other exemptions when transporting hazardous materials including anhydrous ammonia, flammable gases, explosives, or 20+ loaded freight cars with hazardous substances.
