HB488 Summary

• Amends Section 9-8-25 of the Alabama Code to provide limited civil liability immunity to soil and water conservation district supervisors and employees who loan or rent equipment and supplies for soil conservation and erosion control.

• Immunity applies only to actions related to the use of loaned or rented equipment, provided the equipment is maintained in proper working condition, the transaction is in good faith, and damage or injury was not caused by unreasonable behavior of the supervisor or employee.

• Extends existing authority allowing districts to make agricultural and engineering machinery, equipment, fertilizer, seeds, and other materials available to landowners for soil conservation and erosion prevention operations.

• Becomes effective on the first day of the third month following passage and approval by the Governor.
