AL HB544

Creates a new crime of making a false sexual allegation under Alabama Code Section 13A-6-72, requiring willful, knowing, and malicious intent to make false reports of rape, sodomy, sexual torture, or related sexual offenses that are proven to be false.

Establishes two offense levels: making false allegations regarding first-degree rape, first-degree sodomy, or sexual torture is a Class C felony; making false allegations regarding second-degree rape, second-degree sodomy, sexual misconduct, sexual abuse, indecent exposure, and related crimes is a Class A misdemeanor.

Makes persons who make false sexual allegations liable to the accused person for all costs associated with their legal defense.

Excludes the bill from Amendment 621 constitutional requirements regarding local government expenditures because it defines a new crime.

Becomes effective on the first day of the third month following passage and gubernatorial approval.
