HB75 Summary

• Amends Section 11-42-21 of the Alabama Code to allow annexation of property in overlapping police jurisdictions when all property owners and affected municipalities consent to the annexation.

• Permits a municipality to annex property in overlapping police jurisdiction areas up to a boundary equidistant from the corporate limits of each overlapping municipality.

• Allows a municipality to request that all municipalities with overlapping police jurisdictions adopt resolutions assenting to annexation, enabling the annexing municipality to acquire entire parcels that would otherwise require multiple separate annexations.

• Requires annexation petitions to include an accurate property description, a map showing the property's relationship to corporate limits, and signatures of all property owners, with the municipality filing the annexation description with the probate judge.

• Exempts Talladega, Clay, and Calhoun counties from the provisions of this act; effective immediately upon passage and gubernatorial approval.
