HB88 Summary

• Creates the Alabama Sunrise Act requiring the Sunset Committee to review proposals for regulating professions or occupations before they are regulated by the state.

• Establishes that professions and occupations can only be regulated if necessary to protect public health, safety, or welfare from significant and discernible harm, and regulations must not unnecessarily restrict entry or availability of services.

• Requires proponents of new profession or occupation regulations to provide the Sunset Committee with detailed information including number of affected individuals, documentation of public harm, complaints history, comparable state laws, existing protections, and training costs.

• Directs the Sunset Committee to analyze proposed regulations against five criteria: potential for substantial harm, specialized skill requirements, job creation/retention impact, alternative protection methods, and overall cost-effectiveness and economic impact.

• Becomes effective on the first day of the third month following passage and approval by the Governor.
