HB98 Summary

• Amends Alabama Code Sections 18-1A-3 and 18-1A-22 to regulate condemnation actions and right-of-way acquisitions by the state and political subdivisions.

• Adds definition of "waiver valuation" as an alternative valuation process that may be used in lieu of formal appraisals for acquiring real property under specified conditions.

• Permits use of waiver valuations when the property owner donates the property and releases the condemnor from appraisal obligations, or when the anticipated acquisition value is equal to or less than the amount specified in 49 CFR Section 24.102(c)(2)(ii).

• Requires the person preparing a waiver valuation to base their determination on available evidence of the property's value in the local real estate market.

• Becomes effective immediately upon passage and approval by the Governor.
