SB139 Summary

• Amends Code of Alabama Sections 18-1A-3 and 18-1A-22 to allow the state and political subdivisions to use waiver valuations instead of appraisals for right-of-way property acquisitions.

• Permits waiver valuations when property owners donate land and release the state/subdivision from appraisal obligations, or when the state/subdivision and owner consent and anticipated acquisition value does not exceed the federal threshold in 49 CFR Section 24.102(c)(2)(ii).

• Defines "waiver valuation" as the valuation process and product used by the state or political subdivision in lieu of an appraisal, specifically authorized by Section 18-1A-22.

• Requires the person preparing a waiver valuation to base their determination on available evidence of real property value in the local real estate market.

• Becomes effective immediately upon passage and approval by the Governor or upon otherwise becoming law.
