• Private water system utilities serving fewer than 1,000 customers in Class 8 municipalities must obtain municipal approval via petition before exempting themselves from Public Service Commission regulation.

• Exemption from Public Service Commission oversight requires filing a written municipal resolution approval with the Public Service Commission to become effective.

• Exemption elections remain effective until revoked by the municipality through resolution, with the revocation also submitted to the Public Service Commission.

• Private water utilities may maintain existing rates and charges at the time of election without further municipal approval, but the municipality must thereafter approve any rate changes that are fair, just, and reasonable.

• Act becomes effective on the first day of the third month following passage and approval by the Governor.
