SB207 Summary

• Prohibits leaving a child under 9 years of age or an incapacitated person unattended in a motor vehicle in a manner creating unreasonable risk of injury or harm; vehicles at 99 degrees Fahrenheit or less are presumed safe.

• Grants criminal immunity to any person who enters a locked vehicle by force to rescue a child or incapacitated person if they contact a public safety official first, determine entry is necessary, use only necessary force, and remain with the rescued person until first responders arrive.

• Requires public safety officials contacted about an unattended child or incapacitated person in a vehicle to immediately dispatch a locksmith or towing company with vehicle lockout capabilities.

• Grants public safety officials immunity from both criminal and civil liability when acting reasonably in their employment pursuant to this act.

• Becomes effective on the first day of the third month following passage and approval by the Governor.
