SB285 Summary

• Extends the title hold period on unclaimed motor vehicles from 45 calendar days to 60 calendar days, during which no title may be issued unless the transaction occurred before the vehicle was deemed unclaimed or the vehicle was returned to the recorded owner.

• Requires purchasers of abandoned motor vehicles sold by non-bonded agents to post a surety bond pursuant to Section 32-8-36 to obtain title for any sale on or after January 1, 2020.

• Mandates that sellers of abandoned vehicles provide notice of public auction to the Department of Revenue at least 35 calendar days prior to the sale, including owner information, vehicle identification details, and auction date and location.

• Requires notice to current owners and lienholders stating that if the vehicle is not redeemed within 30 calendar days, it will be considered abandoned and may be sold pursuant to the Alabama Abandoned Motor Vehicle Act.

• Becomes effective January 1, 2020, following passage and approval by the Governor or upon otherwise becoming law.
