SB306 Summary

• Amends Alabama Code sections 13A-11-30 and 13A-11-32 to expand the crime of criminal surveillance to include use of unmanned aircraft systems (drones).

• Prohibits using an unmanned aircraft system to capture photographs, images, video, or audio of another person or their private property without consent in a manner that invades reasonable expectation of privacy, including recording through windows.

• Prohibits using an unmanned aircraft system to view, follow, or contact another person or their private property without consent in a manner that invades reasonable expectation of privacy, including through windows.

• Adds definition of "unmanned aircraft system" as a powered aerial vehicle without human operator that uses aerodynamic forces, excluding satellites and spacecraft beyond Earth's atmosphere.

• Establishes the offense as a Class B misdemeanor and becomes effective the first day of the third month following passage and gubernatorial approval.
