SB426 Summary

• Amends Code of Alabama Sections 29-2-159 and 29-2-165 to authorize the Legislature to negotiate and appropriate a one-time lump sum payout in satisfaction of any base and supplemental compensation certified by the Committee on Compensation for Wrongful Incarceration.

• Applies to persons wrongfully convicted of felonies who served prison time, or persons incarcerated pretrial on state felony charges for at least two years before charges were dismissed based on innocence.

• Current law establishes base compensation of $50,000 per year of incarceration and allows the committee to recommend supplemental amounts as separate bills presented to the Legislature.

• New provision allows the Legislature to negotiate a single lump sum payment instead of installment payments or separate appropriations for base and supplemental compensation.

• Becomes effective on the first day of the third month following passage and approval by the Governor.
