SB98 Summary

• Revises unlawful possession of marijuana in the first degree to require possession of two or more ounces, classified as a Class C felony.

• Revises unlawful possession of marijuana in the second degree to require possession of one or more ounces but less than two ounces, classified as a Class D felony.

• Creates new crime of unlawful possession of marijuana in the third degree for possession of less than one ounce, with first or second offense as a violation punishable by fine up to $250 and third or subsequent offense punishable by fine up to $500, with violations not appearing on criminal record.

• Excludes violations of the third-degree charge from being accompanied by charges under Section 13A-12-260 and exempts edible cannabis derivatives and authorized CBD products from application of these sections.

• Becomes effective on the first day of the third month following passage and approval by the Governor.
