HB140 Summary

• Amends Section 22-27-2 of the Alabama Code to expand the definition of "landfill" to include landfills covered with substances other than earth, in addition to traditional earth cover.

• Introduces "Alternative Cover" as a new defined term, allowing materials other than earth to cover landfills and sanitary landfills if approved by the Department of Environmental Management and meeting or exceeding the performance standards of earthen cover material under federal EPA rules.

• Modifies the definitions of "Landfill" and "Sanitary Landfill" to explicitly permit the use of alternative cover materials alongside traditional earth cover.

• Renumbers all subsequent definitions in Section 22-27-2 to accommodate the new "Alternative Cover" definition added as subsection (2).

• Takes effect on the first day of the third month following passage and approval by the Governor.
