HB205 Summary

• Expands existing law to make it unlawful to discharge a firearm on school property, extending beyond the current prohibition limited to school buildings and buses.

• Creates a Class B felony for discharging a firearm on school property during school hours or during school activities after school hours.

• Creates a Class C felony for discharging a firearm on school property at other times.

• Provides exceptions for persons justified in using physical force under Section 13A-3-23 and for organized firearm competitions or performances by groups under 26 U.S.C. § 501(c)(3).

• Becomes effective on the first day of the third month following passage and approval by the Governor.
