• Food service establishments may allow pet dogs in outdoor dining areas if the owner files a waiver with the State Health Department and meets specified conditions.

• Required conditions include a separate outdoor entrance for dogs, prominent signage, dogs kept on leash or in carriers, outdoor area at least 12 feet from bars, and regular cleaning and sanitization of contaminated surfaces.

• Pet dogs are prohibited from sitting on chairs, benches, or other fixtures, and food service employees are prohibited from direct contact with dogs while on duty.

• Pet dog owners are liable for any property damages caused by their animals, and emotional support animals are expressly prohibited from food service establishments.

• State and local health departments may not prohibit wine or beer service in establishments that allow pet dogs or in dog parks, provided all other licensing requirements are met.
