HB233 Summary

• Amends Sections 8-1A-17 and 8-1A-18 of the Alabama Code to authorize municipalities to use electronic records and signatures in their operations.

• Allows municipal governing bodies to determine by ordinance whether their agencies, departments, boards, commissions, authorities, institutions, and instrumentalities shall create, retain, and convert written records to electronic records.

• Permits municipalities to decide by ordinance the extent to which their agencies may send and accept electronic records and electronic signatures to and from other persons and create, generate, communicate, store, process, use, and rely upon electronic records and signatures.

• Requires governmental agencies using electronic records and signatures to specify the manner and format for creation and storage, the type of electronic signature required, and control processes to ensure preservation, integrity, security, confidentiality, and auditability of electronic records.

• Takes effect immediately upon passage and approval by the Governor or upon otherwise becoming law.
