HB25 Summary

• Amends Section 13A-10-52 of the Alabama Code to elevate the penalty for intentionally fleeing or attempting to elude a law enforcement officer from a Class A misdemeanor to a Class C felony.

• Increases the penalty to a Class B felony when flight or eluding causes death or physical injury to innocent bystanders or third parties, up from the current Class C felony.

• Maintains the existing requirement that courts order suspension of the defendant's driver's license for a period of not less than six months nor more than two years.

• Exempts the bill from Amendment 621 constitutional requirements regarding local expenditures because it defines a new crime or amends the definition of an existing crime.

• Becomes effective on the first day of the third month following passage and gubernatorial approval.
