AL HB304

Upgrades assault on a first responder from Class C felony to Class B felony when a person intends to prevent a peace officer, detention/correctional officer, emergency medical personnel, utility worker, or firefighter from performing lawful duty and causes physical injury.

Creates new crime of "assault or attempted assault of a first responder" as a Class A felony when a person intentionally or recklessly causes physical injury to an unarmed first responder using a deadly weapon or dangerous instrument during performance of duty.

Defines "first responder" to include peace officers, detention/correctional officers, emergency medical personnel, utility workers, and firefighters.

Includes provision clarifying that off-duty peace officers working in approved uniforms with law enforcement agency approval are considered to be performing lawful duty for purposes of these crimes.

Becomes effective on the first day of the third month following passage and approval by the Governor.
