HB312 Summary

• Amends Alabama Code Section 15-10-3 to revise circumstances allowing law enforcement officers to arrest individuals without a warrant.

• Modifies warrant requirement language in subsection (6) to clarify that officers must show the warrant upon request as soon as possible, and inform arrested persons of charges and warrant issuance if warrant is not in officer's possession at time of arrest.

• Maintains eight existing grounds for warrantless arrest including crimes in officer's presence, felonies, probable cause situations, protection order violations, and domestic violence or elder abuse offenses based on probable cause.

• Requires officers investigating domestic violence or elder abuse allegations to make a written report documenting the alleged incident, complaint statement, and case disposition regardless of whether an arrest is made.

• Mandates arrested defendants charged with domestic violence or elder abuse crimes be held in custody and brought before court within 48 hours for protection order enforcement and bail consideration under Section 15-13-190.

• Becomes effective on the first day of the third month following passage and approval by the Governor.
