HB316 Summary

• Amends Section 32-13-2 of the Code of Alabama 1975 to authorize parking enforcement officers and traffic enforcement officers in Class 1 municipalities (not required to be certified by the Alabama Peace Officers' Standards and Training Commission) to order vehicle removal, in addition to law enforcement officers.

• Allows vehicle removal to a garage or place of safety under three conditions: vehicle left unattended for at least 48 hours, vehicle left unattended due to driver arrest or impairment, or vehicle subject to an impoundment order for outstanding traffic or parking violations.

• Limits liability for law enforcement officers, parking enforcement officers, and traffic enforcement officers causing vehicle removal to gross negligence only.

• Authorizes property owners, lessees, and their agents to remove unclaimed vehicles from their property and establishes a lien on the vehicle for reasonable removal and storage fees.

• Becomes effective on the first day of the third month following passage and approval by the Governor.
