HB317 Summary

• Amends Section 45-37A-51.237 of the Code of Alabama to increase the percentage of retired police officers and firefighters that the City of Birmingham may rehire from 10% to 20% of their authorized force as of May 18, 2017.

• Allows retired public safety officers (law enforcement and firefighters) to continue receiving retirement benefits while reemployed by the city during critical personnel shortages, provided they have been retired for at least 45 consecutive days before rehire.

• Limits total reemployment period to a maximum of 10 years from the date of rehire and prohibits accrual of additional retirement service credit during the reemployment period.

• Restricts rehired law enforcement officers to ranks below sergeant and rehired firefighters to ranks below apparatus operator lieutenant, with no promotions allowed above these ranks.

• Requires the City of Birmingham to obtain an actuarial study certifying that the act is cost neutral to the city's retirement system prior to implementation.
