HB38 Summary

• Amends Section 16-13B-2 of the Code of Alabama 1975 to add a new exemption allowing city and county boards of education to lease goods or services through nationwide cooperative purchasing programs without competitive bidding requirements.

• Permits leases through purchasing cooperatives sponsored by the National Association of Counties or other national or regional governmental cooperative purchasing programs if goods or services result from a competitive bid process.

• Requires that leased goods or services be unavailable on the state purchasing program or available at equal or lower prices, and prioritizes participating Alabama vendors with valid business licenses when available.

• Makes contracts violated under this chapter void and establishes violations as a Class C felony.

• Takes effect on the first day of the third month following passage and gubernatorial approval.
