HB401 Summary

• Increases the privilege assessment on nursing facilities from $1,899.96 to $2,227.44 per bed annually, effective September 1, 2020, with the $327.48 addition included in Medicaid per diem rates starting October 1, 2020.

• Establishes methodology for recalculating current asset value used in nursing facility rates by adding 41.03% of the June 30, 2020 rebasing amount, effective for cost reporting periods beginning July 1, 2020.

• Creates a Medicaid quality incentive program with a minimum $5,000,000 annual fund for nursing facilities meeting quality measures based on five MDS Quality Measures and three customer satisfaction survey categories, with awards paid by February 1 following each scoring period.

• Renders any section of the article void if federal financial participation under Title XIX of the Social Security Act is not available at the approved federal medical assistance percentage, while keeping other eligible sections in effect.

• Effective immediately upon passage and approval by the Governor.
