HB46 Summary

• Prohibits smoking of tobacco products or vaping in motor vehicles when a child aged 14 years or under is present, whether the vehicle is in motion or at rest.

• Defines "smoke" according to Section 22-15A-3 of the Alabama Code, "tobacco product" according to Section 28-11-2, and "vape or vaping" as electronic nicotine delivery systems carrying liquid nicotine containers.

• Violations are punishable by a fine not exceeding $100 for each violation.

• Violations constitute a secondary offense that can only be enforced after a lawful traffic stop based on probable cause of another violation of law.

• Effective on the first day of the third month following passage and approval by the Governor.
