Town of Garden City governing body may own, operate, manage, and preserve the former Garden City school property, including ball fields and historical structures, currently owned by the Cullman County Board of Education.

Governing body members are immune from civil liability for actions taken in conducting their duties relating to the Garden City school property, to the extent allowed under Section 36-1-12, Code of Alabama 1975.

Town of Garden City may accept title to the property and receive state, local, and other governmental funding as well as charitable donations for operation, management, and preservation.

Selling or transferring ownership of the property requires approval by majority vote of the governing body and then by majority vote of qualified electors in the Town of Garden City at a referendum called by the Judge of Probate of Cullman County during the following general election.

The act becomes effective immediately following passage and approval by the Governor or otherwise becoming law.
