HB 56 Summary

• Prohibits the sale of drug paraphernalia on or within three miles of any public or private school, college, university, or other educational institution in Alabama.

• Prohibits the unlawful sale of controlled substances on the grounds or within three miles of any church or place of worship in the state.

• Imposes a mandatory five-year incarceration penalty with no provision for probation for violations involving sales near schools or churches, in addition to any other penalties provided by law.

• Establishes that violation of drug paraphernalia sales near schools is a Class A misdemeanor for first offense and Class C felony for subsequent violations; selling to minors under 18 is a Class B felony.

• Becomes effective on the first day of the third month following passage and approval by the Governor.
