HB 58 Summary

• Prohibits covered entities (health care providers, hospitals, and organ transplant centers) from discriminating against individuals with disabilities in receiving anatomical gifts or organ transplants based solely on their disability.

• Requires covered entities to provide reasonable accommodations and auxiliary aids and services to individuals with disabilities, including qualified interpreters, taped texts, supported decision-making services, and equipment modifications.

• Allows covered entities to consider a disability only when a physician determines through individualized evaluation that the disability is medically significant to the transplant, but prohibits considering inability to independently comply with post-transplant requirements if the individual has necessary support systems.

• Requires reasonable modifications to policies and procedures to allow qualified individuals access to transplant-related services unless modifications would fundamentally alter services or create undue burden.

• Becomes effective on the first day of the third month following passage and approval by the Governor.
