HB91 Summary

• Amends Section 13A-12-213 to redefine unlawful possession of marijuana in the first degree as possessing marijuana for other than personal use, or possessing it for personal use after a prior conviction for second-degree marijuana possession.

• Establishes unlawful possession of marijuana in the first degree for distribution purposes as a Class C felony and possession for personal use after prior conviction as a Class D felony.

• Amends Section 13A-12-214 to maintain unlawful possession of marijuana in the second degree (personal use only) as a Class A misdemeanor.

• Makes nonsubstantive, technical revisions to update existing code language to current style, including spelling corrections of "marihuana" to "marijuana" and pronoun updates.

• Becomes effective on the first day of the third month following passage and approval by the Governor.
