SB107 Summary

• Requires any person applying for a business license or permit from a county or municipality who employs at least one person to submit an affidavit to the Secretary of State proving E-Verify enrollment before license issuance or renewal.

• Affidavit must include the employer's federal work authorization user identification number and enrollment date, and will be catalogued in a statewide public database maintained by the Secretary of State.

• For license renewals after initial affidavit submission, applicants may simply submit their federal work authorization user number if unchanged; a new affidavit is required if the number differs, accompanied by a sworn explanation.

• Knowingly submitting a false or misleading affidavit constitutes a Class C misdemeanor.

• Effective date is the first day of the third month following passage and approval by the Governor.
