• Expands the Committee on Alabama Monument Protection's jurisdiction to include architecturally significant buildings, memorial buildings, memorial streets, and monuments located on public property that have been in place for 40 or more years.

• Establishes a rebuttable presumption against relocation, removal, alteration, renaming, or disturbance of protected structures that have been situated for 40+ years, requiring a waiver petition from the controlling entity.

• Requires waiver petitions to include a resolution from the controlling entity, written documentation of origin and intent, commentary from heritage and historical organizations, and any newly discovered facts supporting the change.

• Reduces daily violation penalties from $25,000 to $10,000 per day for entities that violate the restrictions or fail to comply with committee-imposed conditions, with fines collected and deposited into the Alabama State Historic Preservation Fund.

• Establishes automatic waiver approval if the committee fails to act within 90 days of application submission, and allows temporary relocation without waiver approval for emergency repairs provided the structure is restored within one year.
