SB128 Summary

• Faculty and staff hired before June 1, 2020, at Alabama community and technical colleges remain subject to the Students First Act of 2011.

• Faculty and staff hired on or after June 1, 2020, are subject to policies adopted by the Board of Trustees regarding tenure, discipline, termination, transfer, reassignment, reductions-in-force, and other personnel actions.

• Board policies must provide due process rights for employees hired after August 1, 2020, who attain tenure or non-probationary status and face termination for any reason other than reduction-in-force, including an appeal before a neutral decision maker appointed by the Chancellor.

• Presidents, Vice-Presidents, and Chief Financial Officers are excluded from due process protections regardless of their hire date.

• The act became effective immediately upon passage and approval by the Governor.
