SB142 Summary

• Prohibits municipalities from exercising any authority outside their corporate limits after January 1, 2023, unless voters approve reinstatement in a county referendum held in November 2020.

• Requires each county to hold a referendum allowing voters to decide whether municipalities may continue enforcing ordinances, collecting taxes, and regulating subdivision planning outside corporate limits.

• Permits subsequent referenda on the same issue at least two years after the initial vote upon petition by 10 percent of prior county election voters, with no less than four years between subsequent referenda.

• Requires special audits of all police jurisdiction taxes and fees to ensure funds are expended only within the police jurisdiction, with direct expenditures only and no indirect or administrative costs; municipalities lose tax collection authority if found noncompliant for more than 12 months.

• Preserves all existing public and private contracts and mutual aid agreements between law enforcement, fire service, and emergency service agencies effective upon passage.
