SB162 Summary

• Adds new grounds for expungement of criminal records for persons charged as or adjudged youthful offenders, requiring completion of any sentence or probation ordered by the court.

• For misdemeanor offenses, allows youthful offenders to petition for record expungement under Section 15-27-1(a)(6).

• For felony offenses (except violent offenses and driving under the influence), allows youthful offenders to petition for record expungement under Section 15-27-2(a)(7).

• Permits expungement of certain violent felony convictions (promoting prostitution in first degree, domestic violence in third degree, production of obscene matter involving minors) if the person proves by preponderance of evidence they committed the offense while being human trafficked.

• Becomes effective on the first day of the third month following passage and approval by the Governor.
