SB205 Summary

• Removes the restriction that expenses of the Alabama Board of Funeral Service cannot exceed receipts, providing flexibility in financial management while maintaining that board operations shall not be an expense to the state.

• Authorizes the board to acquire, hold, and convey real property in its own name by purchase, gift, lease, lease-with-option-to-purchase, or other lawful means (except eminent domain).

• Creates the Funeral Board Property Acquisition Fund within the State Treasury to hold funds for real property acquisition and improvements, with unencumbered balances carrying over annually instead of reverting to the state General Fund.

• Requires the executive director to transfer a board-determined amount to the property acquisition fund by October 1, 2020, and thereafter transfer 3-7 percent of the board's previous fiscal year receipts annually during October.

• Becomes effective August 1, 2020.
