SB225 Summary

• Prohibits covered entities (health care providers, hospitals, and organ transplant centers) from discriminating against individuals with disabilities in receiving anatomical gifts or organ transplants based solely on their disability.

• Requires covered entities to make reasonable modifications to policies, practices, and procedures to allow qualified individuals with disabilities access to transplant-related services, unless modifications would fundamentally alter services or create undue burden.

• Mandates provision of auxiliary aids and services including qualified interpreters, readers, supported decision-making assistance, and equipment modifications to ensure individuals with disabilities can access transplant information and services.

• Allows covered entities to consider a disability in treatment decisions only if a physician determines through individualized evaluation that the disability is medically significant; prohibits denying transplants based on inability to independently comply with post-transplant requirements if adequate support systems exist.

• Becomes effective on the first day of the third month following passage and approval by the Governor, or upon otherwise becoming law.
