Amends Section 18-1B-2 of the Code of Alabama 1975 to clarify limitations on eminent domain authority for park and recreation facilities.

Excludes recreational trails for biking or hiking from the definition of park and recreation facilities that government entities may condemn through eminent domain.

Preserves existing authority for state and municipal or county governments to exercise eminent domain for streets, roadways, government buildings, and other park and recreation facilities.

Requires that condemned property not used for its intended public purpose be first offered back to the original owner at the original purchase price (minus documented income and transaction taxes) within 90 days before public sale.

Becomes effective on the first day of the third month following passage and Governor approval.
