SB240 Summary

• Authorizes licensed wine manufacturers and holders of federal basic wine manufacturing permits to obtain a wine direct shipper permit allowing shipment of up to 12 cases (9 liters per case) annually per Alabama resident aged 21+ for personal use only.

• Requires wine direct shippers to collect and remit all state and local sales, use, and excise taxes; report annual shipments to the Alcoholic Beverage Control Board; obtain customer age attestations; and permit audits of records.

• Allows common carriers to deliver alcoholic beverages to Alabama residents aged 21+, with requirements to verify age, obtain signatures, maintain shipment records for three years, and file quarterly reports with the Alcoholic Beverage Control Board and Department of Revenue.

• Makes it a Class C misdemeanor to ship wine directly to residents without a permit and authorizes the Alcoholic Beverage Control Board to suspend or revoke permits and impose fines for violations.

• Becomes effective on the first day of the third month following passage and gubernatorial approval.
