• Proposes a local constitutional amendment for Shelby County to bring certain privately owned sewer systems under Public Service Commission jurisdiction for rate regulation and consumer protection.

• Applies only to private sewer entities that use public rights-of-way of public roads, discharge to Grade III or higher wastewater treatment facilities, and bill customers a flat service fee or usage-based fee.

• Public Service Commission shall certify and regulate affected utilities in accordance with Title 37, Code of Alabama 1975, including rates, charges, and rate increases, with implementation timeline determined by the Commission.

• Allows counties, municipalities, or governmental utility service corporations to opt out of PSC regulation if they have a rate control agreement with the sewer entity, with PSC jurisdiction automatically restored if the agreement becomes invalid or is terminated.

• Requires an election on the proposed amendment conducted in accordance with Alabama constitutional provisions and state election laws.
