SB311 Summary

• Establishes the Alabama Residential Building Code based on the International Residential Code, to be adopted by the Home Builders Licensure Board and enforced by local jurisdictions with permitting and inspection programs.

• Creates the Alabama Residential Building Code Advisory Council with 15 appointed members plus the Commissioner of Insurance and State Fire Marshal to recommend residential building code standards and updates.

• Establishes the Alabama Residential Building Code Division within the Home Builders Licensure Board to enforce the code in areas where municipalities or counties do not permit or license residential construction, renovation, or repair.

• Creates the Alabama Residential Building Code Fund with five percent of insurance licensing fees credited to it, appropriating $1,600,000 for fiscal year 2021 to support division operations, local government assistance, and matching grants for code enforcement.

• Requires all residential construction, renovation, and repair to comply with minimum standards of the applicable residential building code beginning January 1, 2025, with mortgagor responsibility to provide permits and inspection reports to lenders.
