SB346 Summary

• Amends Sections 30-3-191 and 30-3-197 of the Alabama Code relating to child support for children with special needs or intellectual disabilities.

• Allows the state Title IV-D agency to direct child support payments to a court-appointed legal guardian or representative payee upon the death of an obligee who was the custodial parent, legal guardian, or representative payee of a child with special needs or intellectual disability of any age.

• Requires the state Title IV-D agency to provide notice to the obligor and appropriate court before redirecting payment to the new guardian or payee.

• Provides that if minor siblings without special needs also receive support from the obligor, the amount for the child with special needs shall be calculated on a prorated basis.

• Becomes effective on the first day of the third month following passage and gubernatorial approval.
