SB45 Summary

• Amends Section 13A-7-4.3 of the Alabama Code to expand the definition of "critical infrastructure" to include pipelines, mining operations, beneficiation infrastructure, and facilities designated as critical infrastructure under 18 U.S.C. § 2339D.

• Defines "unmanned aircraft system" as a powered aerial vehicle without a human operator that may be flown autonomously or remotely, excluding satellites and spacecraft.

• Establishes four criminal offenses for unauthorized entry of critical infrastructure: intentional entry without authority, using fraudulent identification documents, remaining after being forbidden, and entering restricted areas without authorization—each constituting a Class A misdemeanor.

• Elevates the offense to a Class C felony if the person injures, damages, or interferes with critical infrastructure operations during unauthorized entry.

• Elevates the offense to a Class C felony if the person possesses or operates an unmanned aircraft system with attached weapons, firearms, explosives, or ammunition while committing the unauthorized entry crime; preserves lawful assembly and peaceful protest rights.
