SB77 Summary

• Amends Alabama Code Sections 16-13B-2 and 41-16-51 to explicitly include leases and lease/purchase agreements within competitive bid law exemptions for purchases made through national or regional governmental cooperative purchasing programs.

• Applies to city and county boards of education and other state and local governmental entities purchasing goods or services through cooperatives sponsored by the National Association of Counties or similar programs.

• Requires that leased or lease/purchased goods and services must be available as a result of a competitive bid process approved by the Department of Examiners of Public Accounts.

• Maintains existing conditions that purchases must be unavailable on the state purchasing program or offered at equal or lower prices than the state program, and must utilize Alabama vendors when available.

• Becomes effective immediately upon passage and approval by the Governor.
