HB107 Summary

• Repeals Sections 13A-5-9 and 13A-5-10 of the Alabama Code, eliminating the Habitual Felony Offender Act which previously imposed enhanced penalties for defendants with prior felony convictions.

• Provides resentencing opportunities for defendants currently incarcerated or under supervision whose sentences were based on the repealed Habitual Felony Offender Act, using sentencing standards in place at time of resentencing.

• Makes technical revisions to sentencing provisions in multiple code sections, including removing references to the habitual felony offender enhancement from drug trafficking, hate crime, and other offense statutes.

• Clarifies that certain felonies (including cruelty to animals and school bus violations) are excluded from habitual felony offender consideration, and that DUI convictions are not subject to habitual felony offender enhancement.

• Becomes effective immediately upon passage and approval by the Governor.
