HB109 Summary

• Amends Sections 12-18-10 and 12-18-61 of the Code of Alabama 1975 to revise compensation for retired justices and judges called to interim active duty status.

• Retired appellate court justices or judges called to interim active duty receive additional compensation up to 25 percent of the actual salary of an active appellate court justice or judge with 20 or more years of service, subject to available funding.

• Retired circuit judges and district judges called to interim active duty receive additional compensation up to 25 percent of the actual salary of an active circuit or district judge with 20 or more years of service, subject to available funding.

• Requires interim active duty status for retired circuit and district judges to be approved by the presiding judge request, Chief Justice and Administrative Office of Courts certification of need based on judicial weighted caseload study, and concurrence by the presiding circuit judge, with annual recertification required.

• Makes nonsubstantive technical revisions to update code language to current style and becomes effective the first day of the third month following passage and approval.
