HB142 Summary

• Requires wireless telecommunications service providers to install and activate filters blocking access to material harmful to minors on all internet-capable wireless devices, effective January 1, 2022.

• Prohibits retailers from selling or leasing wireless devices unless they contain a preinstalled and active filter that can be deactivated or customized by adults and parents using a unique passcode.

• Filters must work across internet, mobile data networks, applications, and home/public wireless networks, and must be resistant to deactivation by minors.

• Authorizes civil actions with penalties of $500 per unfiltered harmful item, device reimbursement, and attorney fees if providers fail to respond to reports of breached filters or fail to update filters with newly identified harmful material.

• Makes it a Class A misdemeanor for non-parents to share the filter passcode with a minor if it results in exposure to harmful material.
