HB165 Summary

• Amends Section 10A-1-4.31 of the Alabama Code to authorize the Secretary of State to waive the $25 Certificate of Existence fee for business entities when a state of emergency is declared in Alabama, another state, or by the federal government that renders substantial compliance impossible or unreasonable.

• Maintains existing fee schedules for business entity filings, including $200 for certificates of formation, $100 for amendments and dissolutions, $25 for name reservations, and $150 for foreign entity registration.

• Preserves the Secretary of State Entity Fund as the repository for all entity-related fees, with 70 percent of remaining funds (after county payments) deposited to the State General Fund.

• Becomes effective immediately upon passage and approval by the Governor or upon otherwise becoming law.
