HB172 Summary

• Adds Section 41-4-177.10 to Alabama Code establishing definitions for minority individuals (African American, Hispanic, Asian American, Native American), minority-owned businesses (at least 51% owned by minorities), small businesses (50 or fewer full-time employees), woman-owned businesses (at least 51% owned/controlled by women), and small or disadvantaged businesses.

• Requires the Chief Procurement Officer to collect and maintain data on small and disadvantaged businesses from the Secretary of State, Department of Labor, and other sources, and track what proportion of state procurement contracts are awarded to these businesses.

• Mandates the Chief Procurement Officer submit a summary of collected data to the Contract Review Permanent Legislative Oversight Committee by the end of February each year.

• Requires the Secretary of State to adopt rules and procedures to identify small or disadvantaged businesses authorized to operate in the state and report data to the Chief Procurement Officer no later than January 31 annually.

• Becomes effective immediately upon passage and Governor approval, contingent on enactment of SB ____ (2021 Regular Session) creating the Office of Chief Procurement Officer.
