HB191 Summary

• Amends Section 11-42-21 of the Code of Alabama 1975 to allow annexation of property in overlapping police jurisdictions when all property owners and all affected municipalities consent.

• Permits a municipality to annex property in overlapping police jurisdiction areas up to a boundary equidistant from the respective corporate limits of each municipality with overlapping jurisdictions.

• Allows a municipality to request consent from all overlapping municipalities by resolution to annex an entire parcel that would otherwise require multiple separate annexations under the equidistant boundary rule.

• Requires annexation petitions to contain an accurate property description, a map showing the property's relationship to corporate limits, and signatures of all property owners.

• Became effective immediately upon passage and approval by the Governor; passed by the House on 23-FEB-21 and by the Senate on 06-MAY-21.
