HB329 Summary

• Repeals the existing Self-Service Storage Act and replaces it with the Self-Service Storage Facilities Act, effective October 1, 2021.

• Grants operators a lien on stored personal property for unpaid rent, late fees, labor, and preservation costs; the lien is superior to all others except tax liens.

• Allows operators to enforce liens by selling stored property after providing at least 20 days' notice to occupants and lienholders via verified mail or electronic mail, followed by at least 7 days of newspaper advertisement or other commercially reasonable advertising.

• Permits operators to deny access to leased spaces upon default and to tow vehicles, watercraft, or trailers after 60 days of unpaid charges without liability for damages.

• Establishes that monthly late fees of $20 or 20 percent of monthly rent (whichever is greater) are presumed reasonable and not a penalty.
